BTAN LLC | Terms & Conditions

These Terms & Conditions ("Terms") govern your use of the BTAN LLC website, booking system, and all services provided by BTAN LLC ("BTAN LLC"). By accessing the website or booking a service, you agree to these Terms.

1. Company Information

BTAN LLC is a luxury mobile and in-studio spray tanning company providing professional spray tanning services throughout the United States where legally permitted. All references to 'Client,' 'You,' or 'Your' refer to any individual accessing the BTAN LLC website, purchasing products or packages, booking services, or receiving services from BTAN LLC.

2. Eligibility to Receive Services

By booking a service with BTAN LLC, you certify that you are at least 18 years old (or have parental consent), have disclosed any known allergies, skin sensitivities, medications, or medical conditions, understand that Brandon Busche, Owner of BTAN LLC and a Certified Norvell Spray Tan Technician, is not a physician or licensed medical professional, and agree to follow all pre- and post-tan instructions provided by Brandon Busche.

3. Booking, Payments & Cancellations

Appointments must be booked through the BTAN LLC website. A valid payment method is required to reserve every appointment and all services must be paid in full at the time of booking. Cancellations made less than 24 hours before the scheduled appointment will be charged 100% of the scheduled service price. No-shows will be charged 100% of the scheduled service price. Promotional pricing and packages are non-refundable.

4. Mobile Service Requirements

Clients must provide a safe, clean, smoke-free, temperature-controlled area with adequate space, an electrical outlet, and all pets secured. BTAN LLC may refuse service if conditions are unsafe.

5. Client Responsibilities & Risk Acknowledgment

Results vary based on skin type, preparation, and aftercare. BTAN LLC is not responsible for staining of clothing or personal property or for reactions caused by undisclosed allergies, medications, or skin conditions.

6. Refunds & Satisfaction Policy

All service sales are final. Refunds are not provided for dissatisfaction with cosmetic results. BTAN LLC may, at its sole discretion, offer a complimentary touch-up. Packages are non-refundable.

7. Website Use & Intellectual Property

All content on the BTAN LLC website is the exclusive property of BTAN LLC and may not be copied, reproduced, distributed, or used without written permission.

8. Privacy Policy

BTAN LLC collects only the information necessary to provide services, process payments, communicate with clients, and maintain business records. Personal information is not sold.

9. Photography & Model Release (Optional)

BTAN LLC respects every client's privacy. Before-and-after photographs will only be taken with the client's voluntary permission. By consenting, you grant BTAN LLC and Brandon Busche a perpetual, worldwide, royalty-free right to use the photographs for advertising, social media, printed materials, educational content, and other lawful business purposes. Images become the exclusive property of BTAN LLC. You waive compensation and approval rights. Declining photography will not affect your ability to receive services.

10. Service Agreement & Liability Waiver

By scheduling, purchasing, or receiving services, you acknowledge the risks of cosmetic spray tanning, certify your health disclosures are accurate, understand Brandon Busche is not a medical professional, assume all risks associated with the service, release BTAN LLC and Brandon Busche from liability to the fullest extent permitted by law except for gross negligence or willful misconduct, and agree that payment constitutes your electronic signature accepting these Terms.

11. Package Terms Addendum

Package purchases are valid only as described at purchase. Packages are non-refundable and may not be redeemed for cash.

Clients who enroll in a Monthly Unlimited Spray Tanning Package during a promotion may receive a Promotional Rate. That rate remains only while continuous enrollment is maintained and all recurring payments are successfully processed. Any cancellation, lapse, failed payment, chargeback, expired card, or interruption permanently forfeits the Promotional Rate.

Returning clients may enroll only at the promotional rate available at that time or, if none is available, at the then-current standard Monthly Unlimited Spray Tanning Package rate (currently $99.00/month plus applicable sales tax).

BTAN LLC does not require long-term contracts. Clients may cancel at any time without penalties. If cancellation occurs after a monthly payment has processed, the package remains active through the end of the paid billing period. Fees are not prorated and no refunds or credits will be issued.

Enrollment authorizes recurring monthly billing until cancellation. Clients are responsible for maintaining a valid payment method. BTAN LLC reserves the right to modify package pricing, benefits, or promotional offers at any time.

12. Limitation of Liability

To the fullest extent permitted by applicable U.S. law, BTAN LLC and Brandon Busche shall not be liable for indirect, incidental, special, punitive, or consequential damages. Maximum liability shall never exceed the amount paid for the specific service. Clients agree to indemnify and hold harmless BTAN LLC and Brandon Busche from claims arising from misuse of services, inaccurate disclosures, negligence, or failure to follow instructions.

13. Health & Safety Disclaimer

BTAN LLC does not diagnose or treat medical conditions. Consult a licensed healthcare professional before booking if you have medical concerns.

14. Rescheduling, Delays & Technician Availability

Appointments may be rescheduled due to severe weather, travel delays, illness or emergency affecting Brandon Busche, equipment failure, product shortages, safety concerns, natural disasters, utility outages, or other events beyond BTAN LLC's control. Clients will be offered the earliest mutually available appointment. BTAN LLC is not liable for losses resulting from such delays or cancellations.

15. Governing Law

These Terms shall be governed by the laws of the state in which services are performed and applicable laws of the United States. If any provision is unenforceable, the remaining provisions remain in effect.

16. Dispute Resolution

Disputes should first be submitted to BTAN LLC in writing for informal resolution. If unresolved, disputes shall be resolved through binding arbitration or another legally recognized alternative dispute resolution process as permitted by applicable law. Both parties waive participation in class actions or class arbitration to the fullest extent permitted by law.

17. Changes to Terms

BTAN LLC may revise these Terms at any time. Continued use of the website or services constitutes acceptance of the revised Terms.
