These Terms & Conditions (“Terms”) govern your use of the BTAN, LLC website, booking system (btan.glossgenius.com), and all services provided by BTAN, LLC (“BTAN, LLC,” “we,” “our,” or “us”). By accessing our website or booking a service, you agree to be bound by these Terms. If you do not agree, you may not use our website or services.

1. Company Information

BTAN, LLC is a luxury mobile and in‑studio spray tanning service operating in the Commonwealth of Kentucky and providing services nationwide where legally permitted. All references to “client,” “you,” or “your” refer to any individual accessing our website, booking services, or receiving services.

2. Eligibility to Receive Services

By booking a service, you confirm that:

You are at least 18 years old or have parental consent.

You do not have allergies or medical conditions that would make spray tanning unsafe.

You understand that BTAN, LLC technicians are not medical professionals and cannot assess medical risks.

You agree to follow all pre‑tan and post‑tan instructions provided by BTAN, LLC.

3. Booking, Payments & Cancellations

3.1 Booking Requirements

Appointments must be booked through our website, booking page, or directly with BTAN, LLC. ALL appointments MUST be secured online with a valid credit or debit card. All services must be paid in advance in order to reserve your appointment. Unpaid appointments will not be held.

3.2 Payments

BTAN, LLC accepts major credit/debit cards and other payment methods listed at checkout. All prices are listed in U.S. dollars and may be updated at any time.

3.3 Cancellations & No‑Shows

To respect our technicians’ time:

Cancellations made 24 hours or more before the appointment incur no fee.

Cancellations made less than 24 hours before the appointment may be charged up to 100% of the service price.

No‑shows will be charged the full-service amount.

Memberships, packages, and promotional pricing are non‑refundable unless required by law.

4. Mobile Service Requirements

For mobile appointments, you agree to provide:

A safe, clean, smoke‑free environment

Adequate space for equipment setup

A location directly next to an electrical outlet (required)

A temperature‑controlled environment

All animals must be put away for the duration of the appointment

BTAN, LLC reserves the right to refuse service if the environment is unsafe or unsuitable. Refusal due to unsafe conditions may still result in full-service charges.

5. Client Responsibilities & Risk Acknowledgment

Spray tanning involves the application of cosmetic solutions to the skin. By receiving services, you acknowledge:

Results vary based on skin type, preparation, and aftercare

BTAN, LLC is not responsible for staining of clothing, bedding, furniture, or personal items

You must follow all aftercare instructions to maintain results

BTAN, LLC is not liable for reactions caused by undisclosed allergies, medications, or skin conditions

You agree to disclose any relevant medical or skin conditions prior to your appointment.

6. Refunds & Satisfaction Policy

Because spray tanning is a cosmetic service with results that vary by individual:

All service sales are final

Refunds are not provided for dissatisfaction with color, fading, or longevity

BTAN, LLC may, at its sole discretion, offer a complimentary touch‑up if appropriate

Memberships and packages are non‑refundable but may be transferred at BTAN, LLC’s discretion.

7. Website Use & Intellectual Property

All content on the BTAN, LLC website—including logos, branding, images, text, and design—is the property of BTAN, LLC and protected by U.S. copyright and trademark laws.

You may not:

Copy, reproduce, or distribute website content

Use BTAN, LLC branding without written permission

Misuse the website or booking system

Unauthorized use may result in legal action.

8. Privacy Policy

BTAN, LLC collects personal information necessary to provide services, including:

Name

Contact information

Service history

Payment details (processed securely through third‑party providers)

We do not sell personal information. We use your information to:

Process bookings

Communicate with you

Improve services

Maintain internal records

Your information is stored securely and accessed only by authorized personnel.

9. Model Release (Optional)

If you choose to allow BTAN, LLC to take before‑and‑after photos of your spray tan:

You grant BTAN, LLC full permission to use, reproduce, publish, and distribute those images on our website, social media, marketing materials, and promotional content.

You acknowledge that BTAN, LLC will have proprietary control over the images.

You waive any right to compensation for the use of these images.

You may decline photography at any time.

10. Service Agreement & Liability Waiver

By booking and paying for your appointment, you digitally sign and agree to the following:

You understand the nature of spray tanning and the products used.

You release BTAN, LLC from liability for any allergic reactions, staining, uneven fading, or results affected by your preparation or aftercare.

You agree that BTAN, LLC is not responsible for damage to clothing, furniture, flooring, or personal items.

You assume all risks associated with receiving cosmetic spray tanning services.

Your payment serves as your digital signature and acceptance of this waiver.

11. Membership Terms Addendum

BTAN, LLC memberships operate on the following terms:

Memberships are billed monthly until canceled by the client.

Membership fees are charged on the 1st of each month.

If you cancel after the 1st, your membership is not prorated.

You may continue to receive membership spray tans until the end of the paid month.

Membership fees are non‑refundable.

By enrolling in a membership, you authorize recurring monthly charges.

12. Limitation of Liability

To the fullest extent permitted by law:

BTAN, LLC is not liable for indirect, incidental, or consequential damages

BTAN, LLC’s total liability for any claim shall not exceed the amount paid for the service in question

You agree to indemnify and hold BTAN, LLC harmless from claims arising from misuse of services or failure to follow instructions

Some states do not allow certain limitations; in those states, BTAN, LLC’s liability is limited to the maximum extent permitted by law.

13. Health & Safety Disclaimer

Spray tanning is a cosmetic service. BTAN, LLC does not diagnose, treat, or advise on medical conditions. If you have concerns about allergies, pregnancy, asthma, or other conditions, consult a licensed healthcare professional before booking.

14. Rescheduling, Delays & Technician Availability

BTAN, LLC may reschedule appointments due to:

Weather

Travel delays

Technician illness

Safety concerns

If BTAN, LLC must cancel, you will be offered the next available appointment.

15. Governing Law

These Terms are governed by the laws of the Commonwealth of Kentucky, without regard to conflict‑of‑law principles. Because BTAN, LLC operates nationwide, these Terms are also intended to be enforceable in all 50 U.S. states to the fullest extent permitted by law.

16. Dispute Resolution

Any dispute arising from these Terms or services shall be resolved through binding arbitration in Kentucky, unless prohibited by state law. You waive the right to participate in class‑action claims.

17. Changes to Terms

BTAN, LLC may update these Terms at any time. Continued use of the website or services after changes are posted constitutes acceptance of the updated Terms.
